Stressed, depressed women terrible at using birth control - TODAY ...

SAN FRANCISCO ? Depression and stress can cause lapses in proper use of contraception, a new study suggests.

In the study, women with moderate to severe depression and stress symptoms were less likely to use contraception consistently ? that is, use it each time they had sex ? compared to women with mild or no symptoms. Women with depression or stress were also more likely to say they did not use contraception at all in the past week compared to women with less severe symptoms.

The findings, presented here on Monday at the annual meeting of the America Public Health Association, are concerning because, although preventing unplanned pregnancies is important for all women, it may be especially important for women with mental health issues, said study researcher Kelli Stidham Hall.

"Perhaps an unintended pregnancy for these women could make things even worse," said Hall, of the University of Michigan's Population Studies Center.

Family planning providers should consider mental health symptoms when they council their patients, Hall said.

In addition, women with depression and stress who do not want to become pregnant in the near future may be good candidates for long-acting reversible contraception, such as an IUD ? highly effective methods of birth control that women do not need to remember to use everyday or each time they have sex, which may be burdensome for some, Hall said.

Hall and colleagues analyzed information 689 non-pregnant women ages 18 and 19 living in Michigan. Participants first answered questions about their mental health. Then, for the next year, they filled out weekly journal entries that included the number of times they had sex in the past week, and whether they used contraception when they had sex.

About 25 percent of women had moderate to severe depression, and 25 percent had moderate to severe stress.

Overall, women used contraception consistently 72 percent of the time. The most common forms of contraception were oral birth control or condoms. For women with depression, the odds of using contraception consistently each week was 47 percent lower than for women with less severe symptoms. For those with stress, the odds of using contraception consistently were 69 percent lower.

Women with depression and stress may have social circumstances, such as unemployment, that interfere with their ability to effectively use contraception, Hall said. In addition, mental health issues may impair a person's ability to make decisions, Hall said.

Early Inness work uncovered at Dallas art museum

(AP) ? An unsigned painting that has been in the Dallas Museum of Art's collection for more than eight decades and was long-believed to have been composed by another artist was likely created by George Inness, one of America's greatest landscape painters, a curator said.

Experts at the museum had thought the oil on canvas, "In the Woods," from around 1850, was painted by Asher B. Durand, a leading figure of the Hudson River School painters in the mid-19th century who was an early influence on Inness.

But experts at the museum began to question the painting's attribution, prompting American art curator Sue Canterbury to research the origin of the painting. As she considered artists who might stylistically fit, Canterbury turned to Michael Quick's book, "George Inness: A Catalogue Raisonne," where she noticed a pen and ink drawing by the artist that closely resembled "In the Woods."

"My heart leapt. I just couldn't believe it," Canterbury said.

The painting, which features a bucolic forest scene, went on display at the museum on Friday reattributed to Inness. Curators have renamed the painting, "Stream in the Mountains."

Canterbury said the reattribution of the painting is significant because it is from Inness' early years, a period of his long career from which not many works have survived. Inness died at the age of 69 in 1894. Canterbury said he changed his style many times during his career.

"It helps art historians understand what he was doing during this period," Canterbury said.

She said comparing the finished painting with the drawing helps "gives us an idea of his artistic process."

Quick, who called the discovery a significant addition to Inness' body of work, suggested the reason not as many paintings have survived from that early period in Inness' career is because he was not as well known then.

Turkey condemns U.N. inertia as Syrian conflict deepens

ISTANBUL (Reuters) - Turkish Prime Minister Tayyip Erdogan rebuked the U.N. Security Council for inaction over Syria on Saturday as war intensified across the country, saying the world body of superpowers was repeating mistakes that led to massacres in Bosnia in the 1990s.

President Bashar al-Assad's forces used air strikes and artillery to bombard insurgents on several fronts in the 19-month-old conflict, which risks dragging in regional powers with no sign of a diplomatic breakthrough.

Turkey - increasingly entangled after having intercepted a Syrian airliner carrying what it said were Russian-made munitions for the Syrian army, infuriating Moscow and Damascus - has led calls for intervention, including no-fly zones enforced by foreign aircraft to stop deadly air raids by Assad's forces.

But there is little chance of United Nations support for robust action given the opposition of veto-wielding Security Council members Russia and China.

"The U.N. Security Council has not intervened in the human tragedy that has been going on in Syria for 20 months, despite all our efforts," Erdogan told a conference in Istanbul attended by dignitaries including Arab League Secretary General Nabil Elaraby. "There's an attitude that encourages, gives the green light to Assad to kill tens or hundreds of people every day."

The bloodshed has worsened markedly in the past two months although neither side has been able to gain a distinct advantage, with government force relying heavily on air power and artillery to batter the rebels.

Combat has been reported nationwide but the crucial strategic battles are being fought in an arc through western Syria, where most of the population lives.

Turkish Foreign Minister Ahmet Davutoglu was expected to meet U.N. special envoy Lakhdar Brahimi on the sidelines of the Istanbul conference later. U.N. Secretary-General Ban Ki-moon said this week Brahimi would visit Syria soon to try to persuade Assad to call an immediate ceasefire.

The government dispatched warplanes to attack insurgent forces surrounding the Wadi-al-Dayf military barracks near Maarat al-Numan in Idlib province, wounding 22 rebels, the Syrian Observatory for Human Rights said.

The rebels captured Maarat al-Numan this week, cutting the main north-south highway linking Damascus, Homs and Aleppo, and government forces will need to retake it in order to reinforce and resupply Aleppo - Syria's largest city and commercial hub.

MEMORIES OF SREBRENICA

The U.N. Security Council, divided between Western powers on one side and Russia and China on the other, has proved helpless in halting a conflict which has spiraled into civil war and killed more than 30,000 people.

Erdogan said a system which allowed one or two nations to block intervention in such a massive humanitarian crisis was inherently unjust, and that Syria would go down in history as a U.N. failure much like Bosnia in the 1990s.

"How sad is that the United Nations is as helpless today as it was 20 years ago when it watched the massacre of hundreds of thousands of people in the Balkans, Bosnia and Srebrenica," Erdogan told the Istanbul conference.

The July 1995 massacre in Srebrenica was the worst on European soil since World War Two, in which Dutch U.N. peacekeepers abandoned what had been designated a U.N. safe haven to advancing Bosnian Serb forces, who then killed 8,000 Muslim men and boys and bulldozed their corpses into pits.

Turkish officials had expressed hope they might be able to persuade Moscow, which sold Syria $1 billion of arms last year, to soften its strident opposition at the Security Council and that if it succeeded, China would follow suit.

But relations between Ankara and Moscow sank to a new low this week after Turkey forced down a passenger jet flying from Moscow and publicly accused Russia of ferrying military equipment to Assad's forces.

Russia has said there were no weapons on the plane and that it was carrying a legal shipment of radar equipment.

REBELS CONTROL BORDER TOWN, FOR NOW

Elsewhere on Syria's battlefronts on Saturday, government forces rained mortar fire down on the opposition-held Khalidiya neighborhood of the city of Homs, the Observatory said. Explosions were felt throughout the besieged district.

To the south of Damascus near Deraa - cradle of the uprising which began with peaceful street rallies - Assad's troops and rebels were fighting on the edge of the town of Maarba.

After four days of heavy fighting in and around the town of Azmarin on the Turkish border, the rebels appeared to have a fragile hold.

Syrian government forces have been shelling the town from the hills and troops have been engaged in street battles with the insurgents over the past week. Shelling continued into Friday evening but only the sound of distant mortar fire could be heard on Saturday as battles for other border areas flared.

"Praise be the town is now in our hands ... We have raised two flags inside the town and the battles are over. Azmarin is completely under our control," one resident, who did not want to be named, told Reuters by telephone from inside the town.

In a preliminary death toll across the country for Friday alone, the Observatory listed about 160 dead. That included 67 civilians, 36 rebels fighters, and 54 government soldiers.

Among the dead were two civilians, including a 3-year-old child, in a bombardment of old Aleppo, a district whose ancient buildings have been severely damaged by the conflict.

TURKISH-SYRIAN TENSIONS

Tensions between Ankara and Damascus have also worsened. Turkey scrambled two fighter jets on Friday after a Syrian helicopter bombed Azmarin and has warned of a more forceful response if Syrian shells continue to fly over the border.

Syria's state news agency SANA said Damascus was ready to accept a Russian proposal for a Syrian-Turkish joint security committee to try to contain the border violence, but there was no confirmation of this on the Turkish side.

The Beirut Star newspaper said in an editorial that the incidents on the Turkish-Syrian border represented a "potentially catastrophic turning point" which could turn the civil war into a regional one.

"With the border increasingly fortified, littered with Turkish and Syrian army tanks, it is beginning to more closely resemble a war zone than a demarcation line between two sovereign territories," it said.

    Romney and Obama focus on debate preparations

    COLUMBUS, Ohio (AP) ? Republican presidential candidate Mitt Romney is preparing for his second debate with President Barack Obama but taking time to tell voters in Ohio that enthusiasm for him is surging both in this critical state and across the country.

    Obama was hunkering down Saturday in Virginia to go over the game plan for the town-hall debate with Romney. But his weekly radio and Internet address on Saturday spoke of an industry that's critical to Ohio, another battleground state and perhaps the most important to his Republican opponent's White House hopes.

    "We refused to throw in the towel and do nothing. We refused to let Detroit go bankrupt," Obama said in the address. "GM is back. Ford and Chrysler are growing again. Together, our auto industry has created nearly a quarter of a million new jobs right here in America."

    Romney opposed using government funds to help the auto industry go through bankruptcy. Many analysts believe the industry would not have survived if it had relied on private investment for rescue. It's an issue that has dogged Romney in Ohio, where numerous auto parts suppliers benefited from the survival of the big three automakers.

    The Obama campaign also released a new TV ad narrated by actor Morgan Freeman noting the challenges Obama inherited and highlighting the president's successes, including saving jobs for American autoworkers and killing Osama bin Laden.

    Romney is concluding a week of campaign rallies that saw him drawing larger, more excited crowds than he has through the fall campaign. More than 10,000 people turned out to several rallies, with the campaign saying that more people were signing up to attend events since Romney's strong debate performance last week in Nevada.

    "I've had the fun of going back and forth across Ohio, and this week I was also in Florida and Iowa, I was in North Carolina and Virginia. And you know what? There is a growing crescendo of enthusiasm," Romney told a crowd of thousands at a sunset rally Friday in Lancaster, south of Columbus, where he and running mate Paul Ryan appeared together. "There's more energy and passion. People are getting behind this campaign. We are taking back this country."

    Saturday will be the fourth of the last five days Romney will spend campaigning in this industrial, Midwestern state ? with 18 electoral votes, it's critical to his hopes of winning the White House. His campaign swing comes as he and Republicans criticize Obama for the handling of the terrorist attack on the U.S. Consulate in Benghazi, Libya.

    Romney accused Vice President Joe Biden of "doubling down on denial" concerning security at the diplomatic post where the U.S. ambassador and three other Americans were killed. During the vice presidential debate Thursday, Biden said "we weren't told" about the Benghazi consulate's requests for additional security. Although a State Department official told Congress on Wednesday about the requests, the White House said Friday that Biden was speaking just for himself and for the president.

    "The vice president directly contradicted the sworn testimony of State Department officials," said Romney, who was eager to stoke a controversy that has flared periodically since the attack. "American citizens have a right to know just what's going on. And we're going to find out."

    Romney plans to spend Saturday morning at a hotel outside Columbus, where he'll meet with top advisers and get ready for his showdown with Obama in Hempstead, N.Y., on Tuesday. He returns to Massachusetts in the evening but first makes two campaign stops in Ohio.

    After his widely panned performance in the first presidential debate, polls show Obama still holds a slim edge in Ohio. The state is crucial for Romney because his path to winning the 270 electoral college votes he needs is far narrower if he can't win Ohio. Losing here would mean he'd have to win almost all of the other up-for-grabs battleground states.

    Obama was in Ohio this week, too, but he was spending the weekend in Williamsburg, Va., preparing for the debate. The president has acknowledged he needs to turn in a stronger performance when the two meet again.

    Obama and top aides plan hours of practice sessions ahead of the town hall-style event, including some mock exchanges with Sen. John Kerry, D-Mass., who is playing the role of Romney.

    Campaign officials sought to keep details of Obama's preparations secret. But they said the president was working on being more aggressive in responding to Romney and calling the Republican out on issues as well as pointing out what they maintain are Romney's true positions.

    While Obama has no public events planned in Virginia over the next three days, his mere presence in the state will drive some local news coverage. And he may make unscheduled visits in the Williamsburg area.

    The president practiced for the first debate in Nevada, another battleground state.

    Hair helps keep you warm, right? But hair can also keep you cooler than bare skin, as long as the hair is not too thick. So says a study in the journal PLoS ONE. [Conor L. Myhrvold, Howard A. Stone and Elie Bou-Zeid, What Is the Use of Elephant Hair?]

    Researchers studied elephants, which have very thin coats of hair. It's easy for the beasts to overheat: they may face temperatures of up to 120 degrees Fahrenheit, and they don't have much skin surface area to radiate the heat relative to their big body volume.?

    That's where the hair comes in. The researchers wrote equations modeling the elephants' hairy skin. As they expected, thick hair traps air and keeps the body warm. But below a certain density, hair stops insulating and wicks heat off the body instead?helping the elephants get rid of an extra 20 percent of their body heat, especially on windless days.

    Heat sinks inside computers work in a similar way, with pins sticking up to help dissipate the interior heat.

    The researchers speculate that hair may have actually evolved to help animals stay cool, because it first sprouted in mammals over a hundred million years ago in a hot climate. Hair-raising times, indeed.

    When Independent Contractors Harass, Are You Liable ...

    Don?t you have enough to worry about with employees sexually harassing each other? But wait. There?s more. As a new ruling shows, employers can also be held liable for the behavior of third-party independent contractors in the workplace?even though they are NOT employees. Now, do we need an extra set of eyes and ears? Yes, indeedy it seems we do!

    Case in Point: Hospital employee Odalys Rosa Santos claimed she was harassed by two doctors who were working as independent contractors at the hospital. Santos alleged that an orthopedic surgeon often proposition her for sex and would spank her in passing. The other physician, an anesthesiologist, allegedly made offensive sexual remarks to Santos on a number of occasions and touched her inappropriately.

    Santos complained about the contractors? behavior to the hospital's personnel director. Soon after, Santos alleged that high-ranking hospital workers stopped talking to her after she made the complaints. In addition, the hospital changed her work schedule, refused to allow her lunch breaks and assigned her duties outside of her job description. Santos eventually resigned.

    She sued both doctors and the hospital, asserting hostile work environment, sexual harassment and retaliation under Title VII. The hospital argued that it could not be held liable for the alleged harassment because the doctors were independent contractors, not employees.

    While a lower court dismissed the claims, an appeals court sided with Santos and sent the case to trial. The court said an employer ?may indeed be liable for a non-employee's acts of harassment under Title VII if it knows or should have known of the conduct and fails to take immediate and appropriate action.? (Santos v. Puerto Rico Children's Hosp.,?D.P.R., 9/28/12)

    The hospital also could not avoid liability based on the?Faragher/Ellerth?doctrine by arguing Santos failed to use the hospital's complaint procedure. The court ruled the defense applies only to harassment committed by an employee's supervisor and does not extend to that by a third party, even if the harasser has a certain amount of control over the employee's work.

    Even if, as the employer claimed, Santos verbal complaint was not in accordance with the hospital's written procedure for reporting harassment, it was enough to establish the hospital's knowledge of the situation. The court warned, ?It is not true that an employee only acts reasonably if the employee follows the employer's formal procedure, and ... the employer is entitled to ignore any notice of harassment that is outside of the procedure.?

    3 Lessons Learned ? Without Going to Court

      1. Keep your eyes open. Keep a vigilant watch of who is working on your premises, including nonemployees. Make sure they get a copy of your organization?s harassment, discrimination and retaliation policies before stepping foot into your workplace. Consider sending the policy out along with the signed contract. These are the ?house rules? and now everybody needs to know about them, including independent contractors.

        2. Keep your ears open. ?Notice? is ?notice,? even if it wasn?t correctly reported up through the designated channels. Once an employer is on notice, it must take immediate action to stop the misconduct. It?s not a legal defense to claim the employee didn?t tell you the ?right way.?

        3. Keep your wallet open. If you don?t follow numbers 1 & 2 above, be ready to pass out the cash, even over contractors.

    Don't use anti-tax avoidance measures to raise revenue: Shome ...

    Anti-tax avoidance measures like GAAR should be used sparingly and not to raise revenue for the government, said Parthasarathi Shome who heads the government committees on taxation matters.

    ?We saw GAAR as a very very special instrument for controlling tax avoidance ? We have to protect our revenue but with these kind of anti-avoidance methods we cannot be expanding our revenues,? Shome said at Merchant Chamber of Commerce & Industry.

    The expert committee on General Anti Avoidance Rules (GAAR) has recommended postponement of the controversial tax provision by three years to April 2016 and abolition of capital gains tax on transfer of securities.

    As a step towards reassuring global investors, the Committee in its draft report, suggested that GAAR provisions should not be invoked to examine the genuineness of the residency of entities in Mauritius. ?GAAR should ensure the application is also very deft and clever so that we can go after cases where we know that there is high chance of winning,? Shome said.

    The Committee has also submitted its final report to Finance Minister P Chidambaram after taking into account stakeholders? comments. ?Our?s was formed as a technical committee. We did not look at the case of this company, that company, etc ? These are methods to control the most integrous methods of avoidance of tax,? Shome said.

    In view of wide-spread concerns by foreign investors, the government had earlier postponed by one year implementation of GAAR which was introduced in the Budget for 2012-13 to check tax evasion.

    Earlier, Central Board of Direct Taxes (CBDT) had come out with draft guidelines on GAAR which did not find favour with Prime Minister Manmohan Singh, who was then looking after the Finance portfolio.

    He had announced setting up of Shome panel to come up with fresh report after talking to stake holders.

    Cell receptor research wins Americans chemistry Nobel

    STOCKHOLM (Reuters) - Two American scientists won the 2012 Nobel Prize for chemistry on Wednesday for research into how cells respond to external stimuli that is helping to develop better drugs to fight diseases such as diabetes, cancer and depression.

    The Royal Swedish Academy of Sciences said the 8 million crown ($1.2 million) prize went to Robert Lefkowitz, 69, and Brian Kobilka, 57, for discovering the inner workings of G-protein-coupled receptors, which allow cells to respond to chemical messages such as adrenaline rushes.

    "Around half of all medications act through these receptors, among them beta blockers, antihistamines and various kinds of psychiatric medications," the committee said.

    Working out better ways to target the receptors, known as GPCRs, is an area of keen focus for pharmaceutical and biotechnology companies.

    Lefkowitz told a news conference by telephone he was asleep when the phone call came from Sweden.

    "I did not hear it - I must share with you that I wear earplugs to sleep. So my wife gave me an elbow. So there it was, a total shock and surprise," he said.

    Sven Lidin, Professor of Inorganic Chemistry at Lund University and chairman of the committee, told a news conference the discovery had been key in medical research.

    "Knowing what they (the receptors) look like and how they function will provide us with the tools to make better drugs with fewer side effects," he added.

    GPCRs are linked to a wide range of diseases, since they play a central role in many biological functions in the body, but developing new drugs to target them accurately has been difficult because of a lack of fundamental understanding as to how they function. Experts say the work of the Nobel Prize winners has opened the door to making better medicines.

    Drugs targeting GPCRs have potential in treating illnesses involving the central nervous system, heart conditions, inflammation and metabolic disorders.

    Mark Downs, chief executive of Britain's Society of Biology, said the researchers had covered important ground in more than one discipline.

    "This ground-breaking work spanning genetics and biochemistry has laid the basis for much of our understanding of modern pharmacology as well as how cells in different parts of living organisms can react differently to external stimulation," he said in a statement.

    Johan Aqvist, Professor of Chemistry at Sweden's Uppsala University, said Lefkowitz was "the father of this entire field".

    "Out of the roughly 1,400 drugs that exist in the world, about 1,000 of them are little pills that you consume, and the majority of these are based in these receptors," he told Reuters.

    Chemistry was the third of this year's Nobel prizes. Prizes for achievements in science, literature and peace were first awarded in 1901 in accordance with the will of dynamite inventor and businessman Alfred Nobel. ($1 = 6.6125 Swedish crowns)

    Crowdsourcing ? Not Just for Businesses Anymore - The MTTLR Blog

    USPTO director David Kappos?is getting things done. He?s opening satellite USPTO offices, helping American University law students patent sex, and now, supporting crowdsourcing prior art searches for patent applications.

    Crowdsourcing is a method of tapping into the collective intelligence of the public at large in order to complete tasks such as gathering medical advice or raising funds. As technology has facilitated the gathering of third-party input, the concept of crowdsourcing has expanded into numerous fields. Now, the USPTO is supporting a new method of crowdsourcing patent prosecution through?Ask Patents, a Q&A forum designed to scour the internet for patenting advice.

    On September 16, 2012, a provision of the Leahy-Smith America Invents Act was implemented to allow, for the first time in U.S. patent law, third parties to submit relevant materials to patent examiners in any given examination. Ask Patents?is a platform that seizes on this opportunity to ask scientific experts, as members of the public, to identify prior art related to patent applications. The patentability of a claimed innovation in a patent application is based on the prior art. Prior art can be another patent, a published article, or a previous implementation. It can be created anywhere, in any language, making it a challenge for patent examiners to fully identify all of the prior art that pertains to a particular claimed innovation. Ask Patents?s parent site, Stack Exchange, describes the new site as a ?crowd-sourced worldwide detective agency to track down and obliterate bogus patent applications.?

    Other forums have tried crowdsourcing patents before. Peer2Patent was a joint project between the USPTO and New York Law School (NYLS) that allows anybody in the public to: (1) review and discuss posted patent applications; (2) search for and upload relevant prior art references; (3) evaluate submitted prior art; (4) gain to opportunity to have his or her references and commentary forwarded to the USPTO. ?This pilot program was a main motivator of the Ask Patents platform after a final review indicated that ?those applications that matured to issuance were more thoroughly vetted and, thus, stronger than many of their counterparts which did not participate in this public review.? Similarly, Article One Partners (AOP) is a privately funded platform that governs a wide network of researchers who are paid to identify publications related to the technology described in patents. Patent applicants or accused infringers can hire researchers in 176 countries to scour world-wide studies translated into nine languages. AOP asserts that this research ?allows our clients to make better patent-related business decisions.?

    The USPTO believes that crowdsourcing will lead to a more exhaustive scope of materials for examiners to review in order to improve the quality of issued patents. After all, why have one person judge if thousands are able and willing to contribute? Gaining access to a worldwide network of scientific experts has great potential. If an entire network of researchers has vetted the patent claims, the strength of the patent is much more secure. Additionally, even highly experienced examiners cannot be experts on every innovation an application might reveal. Innovations, by definition, are often esoteric to most members of even the scientific community. There will be at least a handful of experts whom have the potential to quickly pass on a note that can guide a patent examiner to relevant prior art. Proponents of crowdsourcing argue that high quality researchers will be eager to participate in exchange for the social status and reputation to be gained in the community of scientific experts. Accordingly, the Ask Patents site allows for ratings of its submitters, hoping to tap into this desire to build a strong reputation.

    However, there are conceived limitations to such a system. While proponents argue that public art searches will be expedited, there still remains the limitation that a single examiner is left to process the prior art. When an examiner conducts his own search, he understands what he is looking for, and is able to proceed along a logical thread. When the examiner is inundated with sources, he will flip from one consideration of the innovation to another. This approach may become messy, and ultimately more tedious for the examiners. Additionally, the quality of the results will naturally depend on the members of the public who participate. Some well-meaning submitters may simply yield distractions for the already over-worked examiners. ?Furthermore, it is highly possible, if not likely, that at least a few scientific fields will lack experts that have already signed onto the program. In these areas, researchers with less useful submissions may be eager to help fill the void. If the third-party submissions have been consistently more comprehensive than the examiner?s individual search, it will be easy for an examiner to become too reliant on the third-party submissions.

    ISPs to monitor peer-to-peer file-sharing in new anti-piracy plan

    A long-delayed plan to curb piracy ? a collaboration between ISPs, copyright holders and the White House ? is set to go into effect by the end of the year. The "six?strike" policy for handling those who seek and distribute?copyrighted files is described as educational, but also calls for punitive measures.

    The?"Copyright Alert System" has been in the works for years, and?should be in action in the next few months, Jill Lesser, head of the Center for Copyright Information, told Wired. The CCI designed and has been promoting the alert system. While it was intended to launch sooner, public backlash around?IP protection laws?SOPA and PIPA was seen as potentially endangering the effort.

    Copyright holders, such as the members of the RIAA and MPAA, have in the past resorted to filing thousands of lawsuits against file sharers, a tactic that is not only expensive and time-consuming, but is ineffective as a deterrent and often results in bad PR. There have been several well-publicized cases of people being bankrupted by the fines for trivial amounts of file sharing.

    The CAS is seen as a more reasonable approach, though opponents raise objections regarding some core aspects, particularly that it is being put into place without user feedback. And given some potential outcomes,?the CCI's description of it as an "educational" program doesn't exactly fit right.

    It works like this: Instead of going straight from infringement to a cease-and-desist letter, there is an escalating series of alerts:

    • First and second offense, a courtesy notice that the user's connection was used for infringement.
    • Third and fourth offense, a more conspicuous alert, such as a pop-up or being redirected to a page describing the problem.
    • Fifth and sixth offense, one of several "mitigation measures" may be employed, such as throttling the connection or a more permanent redirect.

    At any time, the user can request an independent review of their case, though it will cost $35 per challenge. Everyone also gets one "get out of jail free" card in the form of claiming the infringement was because of an unsecured Wi-Fi network.?ISPs will have the final word on how far they take the measures, and may choose to go as far as terminating service or doing less than what is suggested.

    Though it's a more realistic approach than what's been tried before, privacy advocates note that the policy still necessitates some level of invasive monitoring on the part of ISPs. And as the Electronic Frontier Foundation told NBC News in an email, the CAS was created and negotiated without any input from affected?users:

    In light of these repeated delays, it's especially frustrating that the?ISPs and the media companies behind this agreement haven't taken the?opportunity to revisit it altogether ? this time with feedback from?actual users. As it stands, the plan is tilted against the many?subscribers of these large ISPs.

    Also, as others have pointed out, the volume of traffic and potential infringement means that many of the infringement allegations will be made by automated systems ? automation that could lead to?embarrassing?mistakes. And while it delineates actions by ISPs, it doesn't restrict or recommend actions by rights holders, who will remain free to sue suspected pirates.

    Reservations aside, it appears the policy will be put in place and any objections or corrections will have to be handled after the fact.

    The ISPs participating are AT&T, Cablevision, Comcast, Time Warner Cable and Verizon; each may implement their alerts?differently.?(NBCUniversal, parent of NBC News, is a subsidiary of Comcast.)

    How the program works in theory is one thing, but the degree to which it will be enforced and the exact nature of the mitigation measures are still unknown. Once the CAS goes into effect later this year, further discussion ??and even?possible tweaks to the system ??are to be expected.

    (AP) ? A nude University of South Alabama freshman had taken LSD and assaulted others before he chased the campus police officer who fatally shot him, authorities said Tuesday, though the student wasn't armed and didn't touch the officer.

    Mobile County Sheriff Sam Cochran said at a news conference that 18-year-old Gil Collar took the potent hallucinogen during a music festival Saturday before assaulting two people in vehicles and attempting to bite a woman's arm.

    Authorities said Collar then went to the campus police headquarters, where he was shot by university police officer Trevis Austin. Austin is on leave while investigators review the shooting.

    Video taken by a surveillance camera showed Collar nude and covered in sweat as he pursued the retreating officer more than 50 feet outside the building, Cochran said. Collar got within 5 feet of Austin and the officer fired once, striking the student in the chest, Cochran said.

    Cochran said Austin came out of police headquarters with his gun drawn after he heard Collar ? a 5-foot-7, 135-pound former high school wrestler ? banging on a door. While campus police typically carry pepper spray and a baton, Cochran said Austin was armed only with a gun during the confrontation.

    An attorney for Collar's family questioned why the officer wasn't able to use nonfatal means to subdue him.

    "Obviously something caused him to act in manner that was somewhat unusual. It still does not justify shooting him down unless there is something we totally missed," said former Lt. Gov. Jere Beasley, who's representing the family.

    The sheriff said it was unclear whether the officer could have avoided the shooting even if he had a non-lethal weapon.

    "Had the officer had a Taser or some other less lethal instrument I don't know if that officer would have had an opportunity to shoulder his pistol and to use something else because the events were evolving so rapidly and he was approaching so close," Cochran said.

    Cochran said he had "serious concerns" about the killing of an unarmed student when he first heard what had happened, but he better understood the officer's decision after watching the video.

    "It's very powerful," said Cochran, whose agency is investigating the shooting along with the local district attorney. The video will be shown to the family and reporters this week, but won't be publicly released.

    Beasley, the Collar family's attorney, said another police employee was at the station with the officer. The officer called for backup but went outside before it arrived.

    "They called for backup, but he goes out by himself without backup. Backup came almost immediately after the shooting. I understand one officer came," he said. Still, Beasley questioned why the officer called for support when facing an unarmed student.

    The sheriff talked with Beasley's chief investigator on Monday, but he did not mention anything about LSD or alcohol.

    "I was surprised it came out at the news conference without contacting the family through us," he said.

    He said there have been no discussions about a lawsuit.

    Investigators are trying to determine who provided Collar with LSD and could charge that person in Collar's death, Cochran said. Authorities received the information about Collar taking the drug from people who were with him at the concert.

    Mobile County District Ashley Rich said a grand jury would decide whether to charge the officer in the shooting, although it wasn't clear when. She said allegations of drug use also could wind up before a grand jury if investigators identify the supplier.

    The clinical director of a drug rehabilitation provider said authorities' description of Collar's actions didn't match the typical behavior of someone who has taken LSD.

    "It's not typical that someone taking LSD would pound on windows or chase people," said Jack Feinberg of the nonprofit Phoenix Houses of Florida, who isn't involved in the case. "The aggressiveness part is something that is just completely foreign. But, of course, drugs are unpredictable, especially if someone has other mental problems."

    He said that the drug is more likely to have a mellowing effect, involving hallucinations. Authorities haven't discussed Collar's psychological condition.

    Critics of the officer's actions are using Facebook to put together a protest of the shooting outside the campus police department on Wednesday morning. Organizers didn't immediately respond to messages seeking comment.

    In a statement issued Tuesday, University of South Alabama President Gordon Moulton said the school is cooperating with authorities and expressed condolences to Collar's family.

    Collar graduated earlier this year from Wetumpka High School, where a vigil in his memory drew about 500 people Tuesday night. The crowd included students, wrestling teammates and people of all ages from the community.

    Speaker after speaker at the vigil remembered Collar as a young man with a great sense of humor and a great love of life. His parents were sitting right behind the speakers. Many in the crowd alternated between laughter and tears.

    Collar wasn't known as a troublemaker and had only two minor scrapes with the law, according to court records: a speeding ticket and a citation for being a minor in possession of three cigarettes in March. He paid a $25 fine for the tobacco possession.

    Two acquaintances at the university have said that before the shooting Collar was out of sorts and appeared intoxicated. He was screaming profanities in the street and running around naked, said South Alabama student Bronte Harber.

    Student Sarah Hay said Monday that Collar was the loudest of a group of four or five young men and some of the others were trying to get him to calm down. She said he was talking about being on a "spiritual quest."

    So, the goals of the our characters will be to figure out which urban legend is true and our characters have to have some type of tie with each other?

    Correct, the tie can be as simple as them having a same class at school together or seeing each other at the library every so often. If your character is new in town then that is okay. ^-^
