Should I Reaffirm My Mortgage After Filing For Bankruptcy?

White House PictureAs a bankruptcy attorney, I get asked many questions each and every day about debt and mortgages. ? Should I reaffirm my mortgage after I file for bankruptcy???The answer is always ? NO. ?Now, this question has started coming in a different format? ?Clients who filed for bankruptcy protection years ago are asking: ?Why didn?t I sign a reaffirmation agreement? ?My mortgage company is telling me that you didn?t file the correct paperwork, and it goes on and on. ?This is where I usually have to take a few minutes to explain why I can give this advice without reservation.

Let?s start with what a reaffirmation agreement is and what it is not. ?My Colleague, Karen Oakes, answered this question in a prior post. ?Basically, the filing of a bankruptcy kills most contracts; including car purchases and home purchases. ?Once the contract is dead, the secured creditor may retrieve its collateral but cannot go after the debtor for any deficiency if the collateral was sold for less than what was owed. ?For example: ?let?s say you owed $10K on a car worth $5K at the time that you filed for bankruptcy protection. ?If you did not sign a reaffirmation agreement, you could surrender the car and pay nothing to the creditor. ?The creditor?s sole remedy was to retrieve their collateral. ?If you signed a reaffirmation agreement, you would breath life back into a dead contract, thereby giving your creditor additional rights under the contract. ?The most significant right or remedy available to the creditor was the ability to go after you for the additional money owed (in our example $5K).

Obviously, the same holds true for mortgage and promissory note on a home. ?If you fail to breathe life back into a dead mortgage and promissory note, the mortgage company is in a worse position than it would be had you signed a reaffirmation agreement. ?So, the mortgage companies want you to sign these agreements during your bankruptcy so that they maintain a superior advantage over you.

Recently, mortgage companies have been trying to coerce individuals into reaffirming debts on homes. ?The new trick is that they will no longer report to the credit reporting agencies that you are current on your monthly payments. ?The mortgage companies want homeowners to reaffirm mortgages that are sometimes 100K upside down.

Likewise, these same companies are telling individuals who filed bankruptcy in the past that they will not report all of the past monthly payments to the credit reporting agencies. ?So, several past clients have called with their concerns. ?Here is how you remedy the situation. ?First, you make all of your regular monthly mortgage payments post-bankruptcy. ?You keep track of when you sent the payment and when the money was withdrawn from your bank. ?This way, you have a current pay history. ?If you have filed bankruptcy in the past, you can always request a payment history from the lender.

Again, these agreements are in the best interest of the creditor, not the debtor. ?This is why it is so easy for me to advise clients not to sign them ?However, some clients are still concerned whether they will be able to keep their homes if they do not sign a reaffirmation agreement. ?In Florida the answer is yes. ?As long as you are current on your monthly payments, you can keep your home. ?I do not let my clients sign reaffirmation agreements on homes that are upside down.

If a client wants to sign a reaffirmation agreement on a home mortgage, they can do so, but I will not sign it.

Going, going, gone: Dodo bone up for auction

A rare four-inch fragment of a femur bone of a dodo, a flightless bird that was hunted to extinction about 300 years ago, will go on sale in April. This picture was released by Christie's auction house in London Wednesday.

LONDON?- A rare four-inch fragment of a dodo bone will go on sale in Britain in April, around 300 years after the flightless bird and icon of obsolescence was hunted to extinction.

Auctioneers Christie's said on Wednesday it was hoping to raise as much as 15,000 pounds ($22,600) for the piece of a bird's femur.
The last sale of dodo remains the auction house could find took place in London in 1934 - and it was expecting considerable interest from a highly specialized band of collectors and enthusiasts.

"It is so rare for anyone to part with these prized items," said James Hyslop, head of Travel, Science and Natural History at Christie's auction house in South Kensington, London.

"From its appearance in "Alice in Wonderland" to the expression 'dead as dodo', the bird has cemented its place in our cultural heritage," he added.

The Western world first heard of dodos in 1598 when Dutch sailors reported seeing them on the Indian Ocean island of Mauritius.

Less than 100 years later, the birds had disappeared. Most experts say they were probably hunted down by successive waves of hungry sailors, and the pigs and other large animals they brought onto the island.

No complete specimens have survived - and scientists have been pouring over fragments of remains for years to try and reconstruct what the dodo might have looked like.

The famous image of a squat, comic, short-necked bird, immortalized in John Tenniel's illustrations for "Alice's Adventures in Wonderland", is widely thought to be wrong.

Christie's did not say whether the thigh bone, part of an unnamed private English collection, would provide any fresh clues.

The auction house said its bone was almost certainly excavated in 1865 at Mare aux Songes in Mauritius during a dig by natural history enthusiast George Clark.

The bone is one of 260 lots in a Travel, Science and Natural History sale held by Christie's in London on April 24. The items are open to public viewing from April 20.

Other items on the block include a fossilized egg from Madagascar's equally extinct elephant bird, more than 100 times the average size of a chicken egg, as well as scientific instruments, maps and globes.

Panasonic plans $2.7 billion of fresh restructuring

TOKYO (Reuters) - Japan's Panasonic Corp said it will spend 250 billion yen ($2.7 billion) over the next two years on a fresh round of restructuring to revive the sprawling electronics giant, but did not indicate if that spending would cover any possible job cuts.

At Thursday's news conference in Tokyo, President Kazuhiro Tsuga said he wants to expand the firm's automotive and housing development businesses as it pulls back from consumer electronics under the company's mid-term business plan.

Like Sony Corp and Sharp Corp, Panasonic's TV unit has been battered by lower-cost Korean rivals able grab market share with cheaper high-quality products. Japan's biggest commercial employer - set to report its second straight annual net loss - is under pressure to dump weak businesses and trim its payroll that even after more than 40,000 job losses in the past two years still comprises more than 300,000 people.

"Panasonic has talked about selling assets, but without cutting workers too, it will come across as a restructuring plan that lacks teeth," said Makoto Kikuchi, the CEO of Myojo Asset Management in Tokyo. "Panasonic does not have the sort of corporate culture which you would expect to see serious layoffs."

Since peaking at $97 billion in 2007, sales have contracted by a fifth. Over the past decade, Panasonic's cumulative net loss adds up to about $13 billion.

Panasonic will also seek external investment in its healthcare business, which Tsuga said he will personally oversee. Panasonic will also sell its majority stake in a logistics business to Nippon Express Co Ltd.

For the next business year, Panasonic expects its net income to reach 50 billion yen, and targets an annual operating profit of 350 billion yen and a margin of 5 percent by March 2016. ($1 = 94.3700 Japanese yen)

    Hi. I'm using DatetimePicke on my SaleInfo form, for inserting the Date and Time of Sale. The dataType of Sale_Date field in SQL Server 2005 is DateTime. I set the DTP format property to short and then to its original default to Long but in both the cases, when i insert the data so only date is displayed validly but the time is fix to 12:00:00 AM. In Addition to this, i changed its value property (which is originally 3/22/2013 2:59 PM, but i removed the time from the value property). Now please tell me that what is this problem, why the current date and time both are not inserting properly? Please guide me.

    if you don't supply a time to a datetime it defaults to 12am if you want the time just use the .Value of your datetimepicker upon insertion into the database. Value will put the current time in

    OK, DateTimePicker. It's used to hold a well, a date and time (or a TimeStamp if you prefer)

    As a developer, you have access to a datetime structure which is what is returned from the DataTimePicker's .Value property.

    This means that you can break it down even further by specifying .Date which appears to be what you're doing.

    Assume you have a datetimepicker with the following showing in the textfield "03/22/2013"

    DateTimePicker1.Value will be equal to #03/22/2013 09:17:00 AM#
    DateTimePicker1.Value.Date will be equal to #03/22/2013#
    DateTimePicker1.Text will be equal to "03/22/2013"

    When you ONLY put a date into a database field that has a type of Date|DateTime|TimeStamp the field will replace a non-existant time with midnight

    If you need a time then as you can see above, passing the value will place the current time into the field without changing the format of your datetimepicker.

    So change the input into the database for the datetimepicker to .Value not .Value.Date

    Dear Charlie. I deleted the old DTP and add a new one on my form and then started insertion of data so you know i just change the format to short and did nothing to its value property and when i check the last inserted records, so its fulfilling my need i.e. the current date and current time of insertion is there in DataBase. I think the problem i am facing with my old DTP is that i modify the value property and removed the time from it on design mode, therefore it inserts the fix time i.e. "12:00". In this case if i bring the value property to its default value, on which it is, when it is added first time on form.

    or in other case, as you mentioned.

    I want this value back in value property #03/22/2013 09:17:00 AM#. I am totally baffle that what to do now, Charlie. I am sorry but i'm not understanding anything.. :dontgetit::dontgetit:

    If I remember correctly, you are inserting these from a DataTable that you create and populate with the entry. Then you loop through the datatable and insert the field into the database. Is that correct?

    If that is correct, look at where you're inserting the date into the database and make sure that you are also inserting time.

    yes its correct. Yes time is available for all of the records. But with some records, the correct time is available and for some records the fix time i.e. 12:00 Am or PM.

    Popular mobile security app Avast! marking Gmail, Whatsapp, others as malware

    Whoopsies. It appears that the popular "Avast! Mobile Security" -- it's got somewhere between 10 million and 50 million downloads from Google Play -- is marking Android's Gmail as malware. You might get a lot of spam and other unwanted e-mail, but that doesn't quite make gmail itself a malware app. This, folks, is what you call a false positive.

    Users of Avast are reporting other false positives as well, including WhatsApp, Linked In, Foscam Remote and others.

    The good news is you can white list it with the app. Also, Avast apparently is aware of the mix-up and has a new set of virus definitions on the way. Support forum moderator Filip Havlicek writes:

    it seems that this false positive detection somehow got through our systems to everyone. I'm sorry for that. Don't worry though, there should be a virus definitions update soon that will remove this detection. I'm going to reroute all topics to this one and lock them so everyone knows what's happening. I'll post here when the update is out so everyone can do a manual update of their definitions to fix this (or you can, of course, wait for the automatic update to happen, but manual will most probably be faster in this case).

    So, yeah. False positive. Let's hope Avast didn't miss anything that actually is malware.

    New Swype beta touts additional Advanced Language Models, Smart Editor enhancements

    Swype's been doing pretty well at keeping the early-adopting folk equipped with the latest and greatest it has to offer in the swiping-instead-of-typing world. And to keep the ball rolling, a new Swype beta (v1.4.9.13905) is now available for those who enjoy trying things before they become available to the masses, with one of the main highlights of this release being the addition of Hindi and Belgium Dutch to the list of Advanced Language Models. There's more, however, as Swype also loaded its latest beta package with under-the-hood enhancements to the Smart Editor and improved tap input responsiveness for all languages it's available in -- which should go hand in hand with those other idiom-friendly features that were announced back in January. Regardless of it being a version sporting an abundance of numerical digits, it's safe to say many avid Swype beta fans will still find it worthwhile -- because, let's face it, who doesn't love betas?

    Sony's 2013 HDTVs start shipping, quantum dots are on the way

    We got a peek at Sony's 2013 HDTV lineup during CES in January, and now the company has announced they're starting to roll out and confirmed official pricing. The new sets add features like NFC, MHL and Miracast support to certain models, while the top of the line W900A is its first to use Quantum Dot technology in combination with edge LED lighting. Sony's brought back its old Triluminos brand name for the technology, which it claims provides a wider color gamut while keeping prices quite a bit lower than its last TVs to rock the tag, the now-retired XBR8 series.

    There's no word on the XBR series, but in the lower W- and R- lines the KDL-W900A is the only one with Triluminos. It also brings an extra long internal speaker duct for improved sound and standard NFC remote, and the 55-inch model will carry an MSRP of $3,299. The step down W802A version keeps MHL standard, has the NFC remote as an option and comes in 55- and 47-inch versions that start at $1,799. The 32-inch W650A will ship for $799. The R-Series dodges some of the higher end features, but some still include 3D, WiFi, RVU and the Sony Entertainment Network suite of apps including Netflix, Hulu Plus and more. The R550A has all that and is available in 70-, 60- and 50-inch versions that start at $1,399.     It's a beautiful late winter day in Bellevue, Wash. Instead of enjoying the outdoors, I'm sitting in a rectangular white room with four programmers, surrounded by three walls covered in augmented reality markers.     As it turns out, the software company is working with Oculus VR to port the tremendously popular free-to-play first-person shooter, Team Fortress 2, to the upcoming Rift development kit. The free update, dubbed "VR Mode," is the latest benchmark in Valve's ongoing hardware initiative. "We think that both augmented and virtual reality are going to be a huge deal over the next several years," Ludwig tells us.
